End User License Agreement
This Agreement is an agreement entered into by and between the User (or "you" or "your") and the Provider of the current Product in respect of the use of the Product. The Provider of the current Product refers to Sangfor Technologies Inc. and its affiliates involved in the provision of the current Product, including but not limited to Sangfor Technologies (Hunan) Co., Ltd., Sangfor Technologies (Changsha) Co., Ltd., and Qingdao Sangfor Vocational Training School Co., Ltd. (hereinafter referred to collectively as "Sangfor", "we", "us", or "our").
If you use the current Product as an Authenticated User, this Agreement is concluded by and between the Customer you represent and Sangfor. After you, as an authorized representative of the Customer, execute this Agreement by clicking or checking the box confirming acceptance of this Agreement according to the authorization of the Customer, the specific rights and obligations specified in this Agreement will be severally or jointly performed by you and the Customer you represent. If you use the current Product as a Non-authenticated User, you acknowledge that this Agreement is concluded by and between you and Sangfor. You or the Customer you represent and Sangfor may be hereinafter referred to individually as a "Party", and collectively as the "Parties".
Please carefully read and fully understand all terms of this Agreement, especially those terms exempting or limiting the liability of Sangfor, terms limiting your rights, and terms on dispute resolution and jurisdiction, as well as other targeted or specific agreements or rules. The limitation or exemption of liability terms or other terms involving your major rights and interests will be highlighted in bold or underlined for your attention.
Please do not use any Product provided by Sangfor, unless you have fully read and understood all terms of this Agreement. By clicking "Agree" "Next" or similar button or check box, or directly using a Sangfor Product, or downloading, installing, and using the Sangfor Product, or registering an account or obtaining account permissions, or logging in to the account, or otherwise accepting, expressly or impliedly, this Agreement, you acknowledge that you have read and agreed to execute this Agreement, and this Agreement constitutes a legal document binding upon both Parties.
1. Important Definitions
1.1 "Product" means all forms of solutions provided by Sangfor, including but not limited to software Products, hardware Products, subscription services, licenses, or other related services, or a combination of the foregoing.
1.2 "Customer" means an entity that has purchased, or plans to purchase and use, or evaluate a Sangfor Product, or any signed distributor that carries out business in collaboration with Sangfor, or any other type of partner, including but not limited to a legal person, government agency, other organization, partnership, or individual business.
1.3 "Authenticated User" means a subject who has obtained an account for or permissions to use a specific Product by registering an account or in any other way permitted by Sangfor and uses the Product features based on the Customer's authorization or instructions or for the purpose of meeting the Customer's requirements. The subject may be an employee or manager of the Customer, or any other person authorized by the Customer.
1.4 "Non-authenticated User" means a subject who has not registered an account or has only registered an account without completing the identity authentication of the Customer or the binding or association of the identity to the account, and browses only the relevant information of a Product or uses specific Product features within a limited scope.
1.5 "User" means the Customer, Authenticated User, and Non-authenticated User, which are hereinafter referred to collectively as the "User", "you", or "your".
1.6 "User Data" means the data that the User provides when registering a Sangfor Product account and using a Sangfor Product, or that Sangfor acquires or collects based on this Agreement (including the Data Processing Agreement) during the User's use of the Product, as well as other related data generated from the foregoing data. The User Data may include the User's network asset information and Personal Information.
1.7 "Personal Information" means any information relating to an identified or identifiable natural person recorded electronically or otherwise, excluding information that has been anonymized.
1.8 "Data Processor" means the organization or individual that has the right to decide on the purpose and method of processing of User Data involved in the use of a Product. Generally, for User Data of a Non-authenticated User, Sangfor is the Data Processor; for User Data involved in an Authenticated User's use of the related Product based on the Customer's authorization, instructions, or requirements, the Customer is the Data Processor and Sangfor is only the authorized party to collect, store, use, process, transmit, provide, disclose, delete, or otherwise process of the User Data in accordance with this Agreement, the Customer's requirements, the Authenticated User's specific operations, or other forms of instructions.
2. Product Use and Restrictions
2.1 Product Licensing
2.1.1 Licensing Statement: Sangfor and the terms and conditions of this Agreement grant you a non-transferable, non-sublicensable, non-exclusive, limited, and revocable license to use the current Product that Sangfor provides to you. Except as provided above, all other rights that are not expressly granted to you under the terms and conditions herein shall remain with Sangfor, and Sangfor does not grant you any implied license under this Agreement. You shall separately obtain the written consent of Sangfor before exercising such rights, and no failure by Sangfor to enforce any of the foregoing rights shall be construed as a waiver of such right.
2.1.2 Licensing and Maintenance: You shall use Sangfor Products in compliance with this Agreement and other applicable rules. Unless otherwise agreed or stated, you shall use the Products hereunder only for non-commercial purposes, and you undertake not to reproduce, copy, sell, or resell the current Product or any part thereof, or use the current Product or any part thereof for any commercial purposes including but not limited to advertising. Regarding the Product that you have obtained a legal and valid license to use, Sangfor shall provide you with the Product features and related services in accordance with the contract signed with you, this Agreement, or other applicable rules, as well as your configurations or other forms of authorization or instructions, and strive to provide comprehensive support and guarantee during your use of the Product.
2.2 Product Use and Restrictions
Sangfor Products are developed in accordance with the laws, regulations, and policies of the People’s Republic of China (for the purposes of this Agreement, excluding Hong Kong, Macao, and Taiwan Region, hereinafter referred to as "China" or the "State"), and are provided to Users within the territory of China in accordance with Chinese laws and regulations. Sangfor provides after-sales maintenance and technical support services only for the Products used within the territory of China. You shall use Sangfor Products in compliance with Chinese laws and regulations.
2.2.1 Cybersecurity Rules
During the use of a Sangfor Product, you undertake not to engage in, or assist or instruct others to engage in, the following acts:
2.2.1.1 Uploading, publicly posting, targeted sending, or otherwise disseminating software viruses or other computer codes, programs, or files that may interfere with, destroy, or limit the functionality of any computer software, hardware, or communication equipment;
2.2.1.2 Illegally intruding, destroying, interfering with, changing, or attempting to change the operation or connection of related Product features, software, server system, or network through technical means, or modifying, adding, deleting, stealing, intercepting, or replacing data in the server system that operates the Product, or illegally occupying the server space in which the Product operates, or performing other acts that overload it;
2.2.1.3 Mining or detecting possible vulnerabilities or defects in the Product or server system by scanning or other means without authorization, or publishing vulnerabilities or defects in violation of applicable laws and regulations, or using relevant vulnerabilities or defects to engage in any act that damages the Product and Sangfor's interests;
2.2.1.4 Producing, publishing, or disseminating any software, media, or methods used for the above purposes, whether commercial or not.
2.2.2 Content Rules
During your use of Sangfor Products, you undertake to comply with the Constitution of the People's Republic of China and other laws, observe public order, and respect social morality, and not to produce, reproduce, publish, or disseminate, or intentionally provide technical support or other convenience or assistance for the production, reproduction, publishing, or dissemination of, information containing the following content:
2.2.2.1 Violating the basic principles determined by the Constitution, endangering State security, honor, and interests, disclosing State secrets, inciting subversion of State political power, overthrowing the socialist system, inciting division of the State, or undermining the State unity;
2.2.2.2 Promoting terrorism and extremism, promoting ethnic hatred or ethnic discrimination, undermining ethnic unity, inciting regional discrimination or regional hatred, undermining religious policy of the State, or promoting cults and feudal superstitions;
2.2.2.3 Fabricating or disseminating false information about dangerous situations, epidemics, alert situations, natural disasters, production safety, safety of foods, drugs, or other products, or other information that disrupts social order;
2.2.2.4 Spreading information that incites illegal assemblies, associations, parades, or demonstrations, or otherwise disturbs the social management order and social stability;
2.2.2.5 Fabricating or disseminating false information that disrupts the economic order and social order or undermines the social stability;
2.2.2.6 Disseminating information about obscenity, pornography, violence, gambling, murder, terror, instigation of crime, impartation of criminal means and methods, manufacturing or trading of prohibited or controlled goods, or commitment of fraud or other illegal and criminal activities;
2.2.2.7 Endangering cybersecurity, or using the network to engage in any acts that endanger State security, honor, and interests or infringe the legitimate rights and interests of others;
2.2.2.8 Disseminating information by pretending to be, or falsely using the name of, State institutions, social organizations, and their functionaries or other legal persons, or disseminating information by falsely using the name of others for the purpose of committing illegal and criminal activities;
2.2.2.9 Disseminating information that insults or slanders others, infringes the reputation, privacy, intellectual property rights, or other legitimate rights and interests of others, endangers the physical and mental health of minors, or is not conducive to the healthy growth of minors;
2.2.2.10 Distorting, defaming, desecrating, or denying the deeds and spirit of heroes and martyrs, insulting, slandering, or otherwise infringing the names, portraits, reputation, and honor of heroes and martyrs;
2.2.2.11 Other content that violates laws and regulations, public policies, social security, or public order and good custom, or infringes the legitimate rights and interests of Sangfor, other users, or third parties.
You are responsible for the legality of the content you publish or disseminate in any way during your use of Sangfor Products. Sangfor has the right to review the content involved in your use of the relevant features or services of the platform, website, or other Products operated and managed by Sangfor. If you violate the aforesaid content rules, Sangfor has the right to remove or block the relevant content at any time without notice, and to restrict the features of your account, or ban or even cancel your account based on the severity of the circumstances, and you shall bear all consequences and responsibilities arising therefrom. In addition, the system logs retained by Sangfor or other recorded data may be used as evidence of your violation of laws and regulations.
2.2.3 Other Rules of Conduct: During your use of related Products, you shall not engage in any acts that violate laws and regulations, socialist system, State interests, legitimate rights and interests of citizens, social public order, morality, or information authenticity, or other violations of laws and regulations, nor engage in any acts that infringe the legitimate rights and interests of other users or third parties or interfere with the normal operation of Sangfor or the stable functioning of our Products or services, or other acts that are not expressly authorized by Sangfor; and you undertake not to provide any convenience or assistance for any other third party's implementation of the foregoing acts.
3. Product Fees
3.1 You shall pay the applicable Product fees according to the purchase and sales contract signed with Sangfor. Subject to your use of the current Product under a legal and valid license, and you do not need to separately pay the fee when signing this Agreement. You understand and agree that Sangfor may, in its sole discretion and on an as-needed basis, adjust the Product features or other services that are available to you free of charge, as well as the free use period or other conditions to be met (Sangfor reserves the right to charge fees for any features or services that are not indicated in writing to be available free of charge), and will provide you with the relevant technical support and guarantee only to the extent provided by laws and regulations or explicitly stated by Sangfor.
3.2 You understand and agree that the operation and maintenance management of any Product will incur a certain cost. If you make a request to Sangfor beyond the scope of the Product features or related services provided by Sangfor free of charge (including but not limited to access to or export of the relevant usage data), in addition to confirming that such request does not violate applicable laws and regulations nor infringes the legitimate rights and interests of third parties, Sangfor has the right to independently assess the reasonableness of your request and the time or other conditions required for the response to your request and require you to bear a reasonable cost required for meeting your request.
3.3 Please take note that you shall pay the Internet access fees, data traffic fees, communication fees, message fees, and other fees charged by third parties that may be incurred during your use of a Product.
4. User Representations and Warranties
4.1 Legal Operation Warranty
4.1.1 Both Parties warrant that they have obtained legal business qualifications or government approvals in accordance with relevant regulations of the State, and that they have the right to operate their respective products, services, or other business in accordance with the law. Both Parties further warrant that they shall maintain the business qualifications or approvals required by relevant regulations of the State during the term of this Agreement. Sangfor provides various Products to you as agreed upon by the Parties or as authorized by you, but we will not participate in the operation of your business or relevant websites, applications, software, or platforms. You shall independently operate and take full responsibility for your websites, applications, software, and platforms, as well as your business and related content.
4.1.2 If you choose to use a Product provided by Sangfor outside the territory of China, you shall assess whether the Product meets your cross-border use requirements, including but not limited to whether the Product meets the requirements of local laws, regulations, and policies, especially the licensing or approval requirements for the cross-border data transfer and cross-border networking. In addition, you shall ensure that the business or non-business activities you carry out, relevant qualifications or licenses you have obtained, and your execution and performance of this Agreement comply with the requirements of local laws, regulations, and policies, and you shall take full responsibility therefor.
4.2 Authorization Warranty
If you are an Authenticated User of the related Product, you shall warrant that you have been legally, validly, and fully authorized by the Customer to use the Product, and you will conscientiously fulfill all responsibilities in accordance with this Agreement and the Customer's rules and regulations, management requirements, and true intention, including but not limited to complying with the rules relating to account registration and use, effectively taking security measures for your account, properly using Product features, and paying attention to protecting the security of information systems and data involved in the whole use process. In addition, you agree that the Customer has the right to manage your use of the Product and related data, rights, and interests based on its operational management, human resources management, or internal information security control, or other requirements. Unless otherwise provided by law, Sangfor does not bear any liability to the Customer or the Authenticated User with respect to the authorization between the Customer and the Authenticated User, the control over permissions to use the Product, and the disposal of related rights and interests, and Sangfor has the reason to believe that all actions you taking within the authorization represent the Customer, and has the right to require the Customer you represent to fulfill the obligations if you are negligent in performing the same.
4.3 Product Use Management
Sangfor can provide diversified Product functional configurations and Product management for you based on your requirements, but Sangfor is not liable for any problems resulting from the account management or configurations performed by you, including but not limited to the following:
Multiple Account Management and Authorized Management or Operation and Maintenance ("O&M"): You can set the Product management mode and allocate management permissions based on your own management requirements, and configure relevant interface or account permissions at the Product management console. You shall establish and improve internal management systems to standardize the use and management of the Product. If you need to authorize a third party to perform management or maintenance or related operations, you should prudently assess the relevant qualifications and capability of the third party and the scope of authorization, and supervise, manage, and evaluate the third party by yourself. You shall take necessary and effective confidentiality and security measures for the usernames and passwords relating to the use of the Product. You are responsible for the above use and management mode you select and the corresponding configurations and authorization. To meet your requirements, Sangfor will believe that relevant operations of all accounts you configure or of the authorized third party have been duly authorized.
4.4 Use of Products Not for Official Sale
You understand and agree that, under certain conditions, Sangfor may provide Products not for official sale to you for evaluation. Such Products are provided on an "AS-IS" and "AS AVAILABLE" basis. Relevant warranty clauses in this Agreement and the SLA and other rules available when the Products are on official sale do not apply to such Products. Sangfor may not provide technical support for such Products, and may also change or cease the provision or test of such Products at any time without further notice. Sangfor has no obligation and does not undertake to officially release or sell any Product that has not been formally released or put on sale. You shall reasonably plan the use of any Product not for official sale that Sangfor provides, and shall not apply or operate such Product in a formal production system or use it to process the true business data. Otherwise, you shall solely bear relevant risks and all possible consequences, including but not limited to any loss resulting from the Product features, performance, stability, or other issues for which Sangfor makes no warranty or technical support issues, and the costs incurred in switching to another product or migrating the related business and data after the Product is discontinued.
4.5 Third-Party Products or Services
4.5.1 If, based on the particularity of the business you operate or manage, your use of a Sangfor Product is conditioned upon a third party's authorization or license, you shall warrant that you have met such condition, and Sangfor will accept your authorization based on your warranty and provide the agreed Product or other related services to you. In addition, Sangfor will not bear any form of joint and several liability for your breach of the agreement with the third party or infringement upon the legitimate rights and interests of the third party.
4.5.2 You understand and acknowledge that Sangfor and the Product provided by Sangfor will keep independent of the third party's products or other business or content; and that you shall make your own judgment and take responsibility for the legality, reliability, suitability, quality, and other aspects of the software or hardware, plug-ins, or tools provided or the advertising, promotion, or publicity information (including commercial or non-commercial information) sent by the third party. Unless otherwise explicitly provided by law, Sangfor shall not be liable for any loss or damage suffered by you due to the products, services, or information provided by the third party.
4.5.3 This Agreement only governs your use of the current Product, and does not apply to any products provided by any third party through the Sangfor Product. Before choosing to use a third-party product, you shall fully understand and confirm whether you accept the agreement or rules applicable to the third-party product.
5. Obligations of Sangfor
5.1 Provision of Products and Related Services
Sangfor shall provide Products and after-sales services to you pursuant to this Agreement. In addition, to provide complete and high-quality Products to you, Sangfor will perform overhaul, maintenance, upgrading, and optimization (collectively, "Routine Maintenance") to the Product itself or the relevant infrastructure or equipment, system, and software that operates the Product on a regular or irregular basis. To ensure the safety and stability of the Product, Sangfor may also make major adjustments such as server room or data migration and equipment replacement. The Routine Maintenance and major adjustments may result in the interruption or suspension of the Product within a reasonable period of time. Sangfor will notify you in advance and you should cooperate. In the event of any non-routine maintenance resulting from force majeure, fault of the basic telecommunication service provider, or other reasons not attributable to Sangfor, Sangfor will strive to notify you as soon as practically possible. Sangfor shall not be liable for breach of contract or damages to you due to such interruption or suspension.
5.2 Disposal of Violations
You agree and accept that Sangfor has the right to continuously supervise and review your use of the related Product features and other services. If Sangfor identifies that you have committed any breach of this Agreement, or receives any question or complaint regarding your violation or infringement from any third-party entity or individual, Sangfor will have the right to investigate and verify the relevant act or information and take relevant measures based on the actual situation, including but not limited to immediately suspending temporarily or terminating your use of the related features or services, removing the relevant information, and making a report to the competent authority, and where necessary, to require you to submit relevant explanations or supporting documents within a prescribed time limit. You agree to cooperate in this regard. Sangfor shall not bear any legal liability for any loss caused to you due to the measures taken under the foregoing circumstance. In addition, Sangfor reserves the right to hold you legally liable and file a claim for all losses thereby sustained against you, including but not limited to investigation fees, litigation or arbitration fees, and attorney fees incurred in protecting our rights, as well as the business loss or claims suffered by or filed against us.
5.3 Prevention of Illegal and Criminal Activities
You shall understand that if a Sangfor Product you use is used to commit illegal and criminal activities such as fraud (including but not limited to sending fraud messages or connecting remote control for the purpose of performing fraud-related operations), gambling, prostitution, or illegal lending in any way, Sangfor will strive to cooperate with the public security or other regulatory authorities in the investigation and evidence collection, and take measures to minimize the loss as far as possible. However, as the Product provider, Sangfor cannot foresee or control the occurrence of such events. Therefore, you should keep cautious during your use of the Product and related services, to prevent risks brought to you by illegal and criminal activities committed by means of the Product.
6. Confidentiality
6.1 Definition
"Confidential Information" means all technical and non-technical information that is disclosed by a Party to the other Party, is non-public, practical and can bring economic or other benefits to the disclosing Party, including but not limited to product or service prices or marketing plans, business plans and strategies, customer lists and customer information, financial information, product development information, or related technical solutions.
6.2 Obligation of Confidentiality
6.2.1 Either Party hereto agrees to maintain the confidentiality of the other Party's Confidential Information of which it becomes aware, and require its personnel who have access to such Confidential Information to strictly fulfill their obligation of confidentiality under this clause. The Party receiving the Confidential Information shall not disclose it to the public, unless the State organ compulsorily requires such disclosure in accordance with the law or the Confidential Information has entered the public domain.
6.2.2 The Parties hereto explicitly acknowledge that their respective business data and other information are their respective important assets and key Confidential Information, and they agree to do their utmost to prevent such Confidential Information from being disclosed. If any risk or event of leakage of Confidential Information is discovered, the Parties shall cooperate to take all reasonable measures to avoid or mitigate the damage arising therefrom.
6.3 Confidentiality Period
The Parties shall bear the obligation of confidentiality during the use of Sangfor Products, unless otherwise agreed upon by the Parties.
7. Data Compliance and Privacy Protection
7.1 For more information about the data processed in connection with your use of the current Product, including but not limited to the data type, purpose and methods of processing, and data security protection, please see the appendix hereto.
7.2 Apart from providing the Product that meets your requirements, Sangfor, as the Product provider, commits to helping you better fulfill the compliance requirements regarding data security and Personal Information protection through the implementation of Product features and the related interactive design, so as to better protect the legitimate rights and interests of you and related individuals. However, you understand and agree that you, as a network operator or Data Processor, shall fulfill primary responsibilities for data compliance and privacy protection, and bear the relevant legal consequences.
8. Intellectual Property Rights
8.1 Sangfor, as the owner of the intellectual property rights in the Product provided to you, is legally entitled to the related copyrights, trademarks, patents, and other intellectual property rights, as well as the trade secrets relating to the Product, which are protected by law. Intellectual property rights are precious intangible assets on which Sangfor's business survives, which are included in both Sangfor Products used by the User and the trademarks, label, and other brand images of Sangfor recognized by the User. Sangfor undertakes to you that Sangfor has independent and complete intellectual property rights in the Product that you have obtained through legal authorization and use within the territory of China, and the Product is free of infringement upon the intellectual property right of any third party or other defects of right.
8.2 You understand and agree that, during your use of a Sangfor Product, you shall not infringe the intellectual property rights or other legitimate rights and interests of Sangfor in any way, including but not limited to: not exploiting, licensing, or assigning, or permitting any third party to exploit, license, or assign, the aforesaid intellectual property rights for commercial or non-commercial purposes without the written consent of Sangfor; not reproducing, modifying, disassembling, decompiling, reverse cracking, reverse engineering, or attempting to access or intercept any source code of the software and hardware Products that Sangfor provides to you and/or any part thereof; not circumventing or destroying any technical measures that Sangfor takes to protect the intellectual property rights; and not modifying, destroying, or covering the trademark or label on the Sangfor Product or the related system platform without authorization. Sangfor reserves the right to pursue the legal liability for any infringement of our intellectual property rights.
8.3 You understand and agree to authorize Sangfor to use the name, trademark, and labels of the Customer in our publicity and promotion, provided that such use is only to indicate the Customer as our Customer or partner.
9. Limitation of Liability
9.1 Disclaimer
YOU UNDERSTAND AND AGREE THAT SANGFOR PRODUCTS ARE PROVIDED "AS IS" BASED ON THE EXISTING TECHNOLOGIES AND CONDITIONS. SANGFOR WILL USE OUR BEST EFFORTS TO PROVIDE HIGH-QUALITY PRODUCTS TO YOU. HOWEVER, DUE TO THE LIMITATIONS OF THE TECHNICAL LEVEL OF THE INDUSTRY OR OTHER OBJECTIVE FACTORS, SANGFOR CANNOT GUARANTEE THAT THE PRODUCTS PROVIDED ARE FREE OF DEFECTS OR FULLY SUITABLE FOR YOUR BUSINESS REQUIREMENTS. THEREFORE, APART FROM THE EXPRESS WARRANTIES THAT SANGFOR MAKES TO YOU IN SPECIFIC SCENARIOS, SANGFOR DOES NOT MAKE ANY UNDERTAKING OR WARRANTY AS TO THE VALIDITY, INTEGRITY, ACCURACY, RELIABILITY, AND TIMELINESS OF THE TECHNOLOGIES OR INFORMATION INVOLVED IN THE PRODUCT PROVIDED, NOR BEARS ANY LIABILITY THEREFOR. IF YOU ENCOUNTER ANY TECHNICAL OR OTHER PROBLEMS BEYOND THE UNDERTAKINGS OR ACKNOWLEDGMENT OF THE PARTIES DURING THE USE OF A PRODUCT, THE PARTIES MAY SEEK SOLUTIONS THROUGH FRIENDLY COLLABORATION.
9.2 FORCE MAJEURE AND OTHER EXCEPTIONS
YOU UNDERSTAND AND AGREE THAT, IF THE PRODUCT FEATURES OR SERVICES ARE INTERRUPTED DURING YOUR USE OF A PRODUCT UNDER ANY OF THE FOLLOWING CIRCUMSTANCES, SANGFOR WILL PROMPTLY COOPERATE WITH THE RELEVANT ENTITY TO MAKE REPAIRS, BUT SANGFOR SHALL NOT BE LIABLE FOR ANY LOSS SUFFERED BY YOU AS A RESULT THEREOF:
9.2.1 FORCE MAJEURE, INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, GOVERNMENT ACTIONS, THE PROMULGATION OF AND CHANGES IN LAWS AND REGULATIONS, STRIKES (EXCEPT FOR INTERNAL LABOR DISPUTES OF EITHER PARTY), UNREST, OR OTHER OBJECTIVE CIRCUMSTANCES THAT ARE UNFORESEEABLE, UNAVOIDABLE, AND INSURMOUNTABLE;
9.2.2 CAUSES ATTRIBUTABLE TO BASIC TELECOMMUNICATIONS SERVICES, INCLUDING BUT NOT LIMITED TO THE TECHNICAL ADJUSTMENTS BY THE TELECOMMUNICATION DEPARTMENT, THE DESTRUCTION OF THE TELECOMMUNICATION OR ELECTRIC POWER LINES BY OTHERS, THE INSTALLATION, TRANSFORMATION, AND MAINTENANCE OF THE TELECOMMUNICATION NETWORKS OR ELECTRIC POWER RESOURCES BY THE TELECOMMUNICATION OR ELECTRIC POWER DEPARTMENT;
9.2.3 CYBERSECURITY INCIDENTS, SUCH AS COMPUTER VIRUSES, TROJAN HORSES, OR OTHER MALICIOUS PROGRAMS, OR HACKING ATTACKS;
9.2.4 INABILITY TO USE THE PRODUCT OR SERVICES NORMALLY DUE TO YOUR USE OF THE PRODUCT FEATURES OR SERVICES IN A MANNER OTHER THAN THOSE PERMITTED BY SANGFOR, OR YOUR IMPROPER OPERATIONS, LOSS OR THEFT OF ACCOUNT, OR FAILURE OF YOUR COMPUTER SOFTWARE, SYSTEM, HARDWARE, OR COMMUNICATION LINES;
9.2.5 OTHER CIRCUMSTANCES THAT ARE NOT ATTRIBUTABLE TO THE FAULT OF SANGFOR AND CANNOT BE CONTROLLED OR REASONABLY FORESEEN BY SANGFOR.
9.3 EXCLUSIONS
IN NO CASE SHALL SANGFOR BE LIABLE FOR ANY INDIRECT, PUNITIVE, SUDDEN OR INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO THE LOSS OF PROFITS, LOSS OF INTEREST, TEMPORARY SUSPENSION OF BUSINESS, OR DESTRUCTION OR LOSS OF DATA OR OTHER ASSETS.
9.4 Cap on Liability
The total liability of Sangfor for breach of contract or damages arising out of the Product provided to you violating the applicable terms of this Agreement or other applicable rules shall not exceed the total fees charged for the Product.
10. Term, Temporary Suspension, and Termination of the Agreement
10.1 This Agreement shall remain valid prior to the termination hereof or the expiration of the license of the current Product (if applicable). You understand and agree that when the conditions for temporary suspension or termination of all or part of the Product features agreed upon by Sangfor with you through the terms of this Agreement or otherwise are satisfied, Sangfor has the right to temporarily suspend or terminate the license to use all or part of the Product features agreed herein by giving unilateral notice to you.
The conditions for temporary suspension specified in this clause include but are not limited to: your refusal to agree to any updates to this Agreement or other applicable rules, or your failure to promptly renew the license upon expiration thereof, or your breach of the obligations under this Agreement, thus resulting in your temporary inability to use the Product features.
The conditions for termination specified in this clause include but are not limited to: your failure to renew the license in a certain period of time after the expiration of the license, your failure to meet the necessary conditions for use of the Product due to breach of your obligations hereunder, or actual loss caused to Sangfor due to your violation of laws.
10.2 Sangfor has the right to adjust or terminate all or part of the Product features based on our own operational arrangements at any time, including but not limited to removal, iteration, or integration of related features, without prior notice. Any changes to the Products are subject to the terms of this Agreement in effect at the time of the relevant changes occur. For the changes that may affect the User’s business, Sangfor will notify you in advance as far as possible, so that you can back up the data to be migrated, adjust your business, or make other preparations, to avoid incurring unnecessary cost or loss.
11. Governing Law and Dispute Resolution
This Agreement is executed in the place where Sangfor is located. The accomplishment, effectiveness, performance, and interpretation of this Agreement, the dispute resolution hereunder, and other matters in connection herewith shall be governed by the laws of the People's Republic of China (excluding the Law of the People's Republic of China on Choice of Law for Foreign-related Civil Relationships) (for the purposes of this Agreement, excluding Hong Kong, Macao, and Taiwan Region). In the absence of applicable laws, the applicable commercial practices may be followed. Any dispute or controversy between you and Sangfor shall first be resolved through friendly negotiation. If no agreement is reached through negotiation, you agree to submit such dispute or controversy to the competent people's court in the place where this Agreement is signed.
12. Miscellaneous
12.1 Relationship
Sangfor and the User are independent contractors, and nothing in this Agreement shall be construed as creating any partnership, agency, employment, or other legal relationship between the Parties. Neither Party nor its affiliate shall be the other Party's agent and have the right to bind the other Party.
12.2 Assignment
Without the prior written consent of Sangfor, you shall not assign or otherwise transfer this Agreement or any right or obligation hereunder. Any assignment or transfer in breach of this clause shall be invalid. You should understand and agree that Sangfor has the right, after notifying you in advance, to transfer all or part of our rights and obligations hereunder to an affiliate of Sangfor.
12.3 Entire Agreement
The text of this Agreement, appendices hereto, policies and documents incorporated herein by reference, as well as other policies, rules, statements, notices, warnings, prompts, and instructions in connection herewith (collectively, the "Rules") constitute the entire agreement between you and us in respect of the current Product. The above Rules are an integral part of this Agreement, and shall have the same legal effect as this Agreement.
12.4 No Waiver
No waiver by Sangfor of any negligence or breach by you under this Agreement shall be construed as a waiver of any other or subsequent similar negligence or breach by you.
12.5 Severability
If any part of this Agreement becomes invalid or unenforceable for any reason whatsoever, it shall not affect the legal effect of the remaining parts hereof.
12.6 Updates to the Agreement
Based on the timeliness, complexity, efficiency, and other characteristics of the Internet, adjustments to laws and regulations, regulatory requirements, or policies, major changes in your or Sangfor's business or operations, iterations or updates of Product features, or other reasons, you agree that Sangfor may update the text of this Agreement, appendices hereto, or applicable Rules from time to time, and the updated Agreement or Rules will be submitted to you for confirmation through the Product page, or separately notified to you in the valid notification manner specified in this Agreement. If you do not agree to the updated Agreement, you should immediately cease the use of the related Product. By continuing using the Product, you acknowledge that you have fully read, understood, and agreed to be bounded by the updated Agreement.
12.7 Notice
12.7.1 Authentic and Valid Contact Information
You shall warrant and maintain the authenticity and validity of relevant information you submit during your use of the related Product (including but not limited to phone number, email address, and other contact information). If the information you submit contains any false, invalid, or other content that may result in your inability to promptly receive business notices, feature or service prompts, technical support, dispute coordination, or violation punishments, you shall bear the relevant responsibility.
12.7.2 Valid Notification
You shall send notifications to Sangfor according to the contact information specified herein or published on Sangfor's official website, unless otherwise agreed upon by the Parties.
Sangfor may send you various information related to our Products or services, such as notices, prompts, verification messages, and marketing information (including but not limited to the updated End User License Agreement, applicable rules, Product or service upgrades, server room migration, and advertisements) by webpage announcement, system notification, private message, email, SMS, instant message, and/or letters. The above information shall be deemed to have been served on the date of sending or publishing (if the information is served on a statutory holiday, it shall be deemed to have been served on the first working day following the holiday).
12.7.3 Push Authorization
To better deliver the required Product or provide the supporting services to you, you agree that Sangfor may, during your use of the Product, send you SMS or emails to push real-time information about the use of the Product or the related Product release or update information according to the mobile number, email address, and other contact information you voluntarily provide when applying for use (including evaluation) of, or activating the Product or a specific feature thereof. Sangfor will provide you with a way to unsubscribe, or you may contact Sangfor customer service to solve the relevant issue for you.
12.8 Export Control Compliance
You undertake to comply with applicable laws and regulations of China, the United States, the United Nations, and other countries/organizations regarding export control and economic sanctions, and to use the Products only for civilian purposes.
12.9 Headings
The headings used herein are for purposes of convenience only, and shall not be separately used as the basis for the interpretation of the terms hereof.
12.10 Language
This Agreement is made in Chinese. Any courtesy translation of this Agreement made available to you is only for reference. In the event of any conflict between the two versions of this Agreement, the Chinese version shall prevail.
12.11 Conflict
In the event of any inconsistency between this Agreement and the specific agreement or rules applicable to a Product feature or service, the specific agreement or rules shall prevail. In the event of any conflict between this Agreement and the purchase contract you have entered into with Sangfor or an authorized distributor of Sangfor in a specific project, this Agreement shall prevail.

Appendix 2: Account Use Agreement
1. Account Registration
1.1 Any user who uses a Sangfor Product shall have necessary and appropriate capacities for enjoying civil rights and performing civil acts in accordance with the law, complete registration according to the real name authentication and other requirements or obtain the right to use an account for the Product in any other way permitted by Sangfor, and conscientiously observe applicable rules and restrictions when registering an account, including but not limited to: not registering and using the account in bad faith (the bad faith registration mentioned in this clause includes but is not limited to frequent or batch registration of accounts, abuse of multiple accounts, and trading of accounts).
1.2 Based on Sangfor's main business and Product positioning and features, we provide account registration and related features or services mainly for adult users. Before instructing or authorizing a minor to register an account for a Product or otherwise use the Product, a subject shall obtain the consent of the minor's guardian and verify the true identity of the authorized minor and the minor's guardian through their ID numbers, and shall pay attention to giving special protection to the minor user's Personal Information and other legitimate rights and interests during the use of the Product.
2. User Information
2.1 You shall fill in and submit true, legal, and valid information as required, including but not limited to the User's name, contact person, email, and phone number, and you agree to submit relevant information of the Customer you represent as required by Sangfor, including but not limited to the business license, qualification documents, and business description, so that Sangfor can perform real-name authentication on relevant subjects or ask a third party to do so in accordance with applicable laws and regulations, or where necessary, verify the authenticity and legality of the business carried out by the relevant subjects by means of Sangfor Products or other related services. If the above information changes, you shall promptly notify Sangfor in writing or update such information according to the use rules for the specific Product.
2.2 You shall ensure that your registered account name, profile photo, profile, and other information do not contain any content that violates laws and regulations, public policies, or public order and good custom, or infringe the legitimate rights and interests of any third party, including but not limited to: not counterfeiting, imitating, or fabricating the names or logos of political parties, party, government, and military organs, enterprises and institutions, people's organizations, social organizations, countries (regions), international organizations, or news media, or geographical names and logos of important spaces; not pretending to be others (including but not limited to the IT administrator) or using the names, portraits, trademarks, or logos of others without authorization; not deliberately containing QR codes, website addresses, email addresses, contact information, etc.; and not containing false, exaggerated, or other content that may deceive or mislead the public.
3. Account Use Rules: When logging in to a Product account and using relevant features or services, you shall conscientiously bear the legal obligations related to the account subject, including but not limited to: not using any Product feature by logging in to the account or other means to commit any acts that violate laws, regulations, or policies; not interfering with the operation of the Sangfor Product or our Product management, or maliciously circumventing or counteracting the rules for related features or services, or breaking the account permissions or other use restrictions by any technical means; not publishing or disseminating in any way illegal or false information or publishing advertisements; and not interfering with the normal use of the Product by other users by giving repeated reviews, meaningless reviews, or false rewards, or in other ways, or otherwise infringing the legitimate rights and interests of others.
4. Account Security Protection
4.1 Your account is used as the basis to identify you as the intended user of the related Product, so you shall take necessary and effective confidentiality and security measures (including but not limited to taking effective access control, setting a strong password, and regularly changing the password) for the username, password, and other information of your account.
4.2 If you discover any unauthorized use of your account and password or any other circumstance that your account permissions are obtained without your legal authorization, you shall immediately notify Sangfor in an effective manner and provide the necessary information, such as the statement of situation, supporting documents, specific appeals, and contact information. Sangfor will handle your request in accordance with laws, regulations, and this Agreement or applicable Rules after receiving a valid notice from you, verifying your identity, and confirming the facts. You shall bear all responsibilities and consequences arising from Sangfor's handling of your request under this clause. If Sangfor fails to handle your request in a timely manner due to our inability to verify your identity or judge your requirements as a result of any defects in the information you provide, you shall bear all losses arising therefrom. In addition, you understand that it takes a reasonable period of time for Sangfor to handle your request and that Sangfor shall not be liable for your losses incurred prior to our adoption of measures or incurred after our adoption of measures for reasons not attributable to us.
5. Account Management
5.1 Apart from the security protection for your account, you shall establish and improve internal management systems to standardize the use and management of your account. In case of any actual breach of this Agreement or other applicable Rules or provisions, you are obliged to immediately notify us, and shall take appropriate actions to stop and correct such breach or violation, and bear the full liability.
5.2 You understand and agree that, if any User breaches this Agreement or other applicable Rules or provisions or is involved in a dispute over account permissions, Sangfor, as the Product operator, has the right to take necessary measures, including but not limited to restricting, suspending, or terminating access to or use of the related Product or other related services, in accordance with applicable laws or this Agreement and other relevant provisions, so as to ensure the secure and effective operation of the Product as far as possible, and you shall bear the loss arising from the clearing or loss of the data relating to your use of the Product; and Sangfor has the right to independently assess and establish a credit management system for your account and provide services or other guarantees for related rights and interests based on the credit rating of your account during the use.
6. Restrictions on Account Permissions and Termination of Account
6.1 Cancellation of Account
Generally, any User who has an account to use a Sangfor Product may independently operate to cancel the account, or apply to Sangfor for cancellation according to the contact information provided this Agreement. However, if you are an Authenticated User, subject to relevant restrictions or approval procedure that the Customer you represent has set when authorizing you to use the Product, you shall ensure that the following conditions are met in order to cancel an account:
6.1.1 The account is in normal conditions and is not involved in any disputes (including complaints or reports filed by or against the account), nor subject to restrictive measures taken by the competent authority;
6.1.2 There is no uncompleted transaction under the account;
6.1.3 There are no other unsettled rights or obligations under the account or disputes that may arise out of the cancellation of the account;
6.1.4 There are no other circumstances that may affect the cancellation of the account.
Sangfor will cease the provision of relevant Product features and other related services to any User who has formally canceled the account. Upon cancellation of your account, we will properly process related data in accordance with applicable laws and regulations and relevant agreements (if any) with you or the Customer you represent.
6.2 To protect the account security, Sangfor has the right to independently detect and judge access exceptions and take corresponding measures. For example, Sangfor has the right to restrict the login function of an account that has not been logged in for a long time after registration or that has no access or operation records for a long time after the login in order to protect the account security, and you can normally use the account after reactivating the account or logging in again.
6.3 Sangfor has the right to recover or terminate the license for your account if you breach relevant provisions of this Agreement or other conditions for temporary suspension or termination of the account as agreed upon by the Parties are established.
Appendix 3: Product Operation and Maintenance Management
1. Software Update Mechanism
1.1 Types and Scope of Software Upgrades
To fully fulfill the obligation to deliver software Products to you and fulfill the legal obligation to maintain the secure and stable operation of the network and system during the delivery process, Sangfor provides software upgrade and update services to you as appropriate based on actual needs, including but not limited to issue fixes (including security or quality issues), software function enhancements, and performance improvements.
To ensure the security of your software, you must promptly download and install the latest upgrades and updates. You understand and agree that, if you reject the security performance update that Sangfor provides for your software, your device may be exposed to serious cybersecurity risk; and if you still choose to reject the update to your software after we remind and inform you of the relevant risk multiple times, you shall bear the loss arising therefrom.
To improve your software features, you must also promptly download and install the latest upgrades and updates. You understand and agree that the implementation of certain software features is subject to version updates; and you may not be able to use certain software features if you fail to promptly update your software to the latest version released by Sangfor, and this may directly restrict Sangfor's provision of relevant technical support services to you. To guarantee and improve your user experience, we strongly recommend that you promptly verify your version update requirements and update your software to the latest version in time.
1.2 Automatic Software Upgrades
You understand and agree that the automatic upgrade and update feature of Sangfor Products can be enabled in order to implement necessary Product features and maintain the secure operation of your network and business in real time. If you enable the automatic upgrade and update feature, your device will automatically search for and download upgrades and updates through the Internet, and automatically complete the corresponding upgrades and updates within the time period you select, and you will be notified of the specific upgrades or updates next time you access the device management interface.
You understand that the upgrade and update service Sangfor provides to you will help you fix network security vulnerabilities and possible quality problems, so as to effectively prevent possible security risks and ensure the security, stability, and continuity of your business. For this reason, we strongly recommend that you keep the default settings of your device, so that the Product you use can receive and install relevant patches in a timely manner. IF YOU FAIL TO COMPLETE CERTAIN PRODUCT UPGRADES OR UPDATES IN A TIMELY MANNER DUE TO YOUR REFUSAL TO ENABLE THE AUTOMATIC UPGRADE AND UPDATE FEATURE, IT MAY LEAD TO SECURITY RISKS OR UNAVAILABILITY OF CERTAIN FEATURES OR SERVICES. THEREFORE, SANGFOR WILL STILL SEND YOU IMPORTANT UPGRADE AND UPDATE NOTIFICATIONS BY POP-UP MESSAGES ON THE PRODUCT PAGE OR BY WECHAT OR EMAIL WHEN WE DEEM IT NECESSARY.
YOU UNDERSTAND AND AGREE THAT SANGFOR FULLY RESPECTS YOUR OWN CHOICE, AND WILL USE OUR BEST COMMERCIAL EFFORTS TO FULFILL THE RELEVANT RISK DISCLOSURE OBLIGATION; AND YOU SHALL BEAR THE POTENTIAL RISKS OR ACTUAL RESPONSIBILITIES ARISING FROM THE OPERATION YOU CONTINUE AFTER BEING FULLY AWARE OF THE POSSIBLE RISKS ASSOCIATED THEREWITH, AND SANGFOR WILL NOT BE LIABLE FOR THE CONSEQUENCES OF YOUR OWN CHOICE AFTER FULFILLING THE REASONABLE DISCLOSURE OBLIGATION.
2. Handling of Vulnerabilities
Sangfor is committed to providing Products with improved security. Our long-term goal is to eliminate security vulnerabilities in all Products before they are released. However, it is impossible to completely avoid vulnerabilities in software during use, so we must be ready to respond to vulnerabilities discovered. Sangfor recommends that you promptly install the latest version of your Product as well as patch updates, so as to keep your Product in a secure state as far as possible.
2.1 Vulnerability Handling Methods
To strive to ensure the secure operation of your Product and business, we will, in accordance with applicable laws and regulations and our agreements with you, undertake the obligation to dispose of, fix, and take preventive measures for, network security vulnerabilities occurring during the operation of the Sangfor Product you use, including but not limited to providing necessary Product upgrade and update services and providing tools to help solve problems, within the after-sales maintenance service period. After a vulnerability is discovered, we will promptly and fully inform you of the possible risks associated with the vulnerability by WeChat, email, or other message push method, or pop-up reminder on the Product backend page, website announcement, or otherwise, and immediately provide solutions for you. Even so, the secure operation of your network Product still requires your active cooperation and maintenance. YOU ACKNOWLEDGE AND AGREE THAT, FOR THE SAKE OF SECURITY, SANGFOR MAY SEND YOU NECESSARY NOTIFICATIONS ABOUT THE HANDLING OF VULNERABILITIES IN THE ABOVE FEASIBLE WAYS, AND YOU AGREE TO RESPOND AS SOON AS POSSIBLE AFTER RECEIVING A NOTIFICATION.
YOU ACKNOWLEDGE AND ACCEPT THAT, SINCE CERTAIN TYPES OF PRODUCT VULNERABILITIES, ONCE EXPLOITED, MAY AFFECT THE STATE SECURITY, SANGFOR MAY PRIORITIZE THE ADOPTION OF APPROPRIATE AND NECESSARY MEASURES TO HANDLE THE SECURITY ISSUE IN AN EMERGENCY, AND NOTIFY YOU OF THE SPECIFIC SITUATION AS SOON AS POSSIBLE AFTER THE EMERGENCY IS ELIMINATED. WE SHALL NOT BE LIABLE FOR ANY ACTUAL DAMAGES SUFFERED BY YOU RESULTING FROM THE EXPLOITATION OR HACKING OF VULNERABILITIES THAT YOU ARE NEGLIGENT IN FIXING.
2.2 Confidentiality of Vulnerability Information
To ensure the security of your Product and business, Sangfor will fix security vulnerabilities occurring in the operation of your Product, and we will inevitably disclose relevant information about the vulnerabilities to you in this process. In accordance with the Cybersecurity Law of the People's Republic of China, Administrative Provisions of Security Vulnerabilities in Network Products, and other applicable laws and regulations, vulnerability information shall be disclosed in strict accordance with the procedures required by the regulatory authorities, by taking into full account the impact of such disclosure on cybersecurity, and no entity or individual shall disclose vulnerability information without authorization in violation of applicable laws and regulations. THEREFORE, YOU ACKNOWLEDGE AND UNDERSTAND THAT, IF SANGFOR DISCLOSES RELEVANT VULNERABILITY INFORMATION TO YOU BEFORE FORMALLY PUBLISHING IT ON OUR OFFICIAL WEBSITE, YOU ARE OBLIGED TO MAINTAIN STRICT CONFIDENTIALITY OF SUCH INFORMATION. SANGFOR SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED TO YOU AND ANY THIRD PARTIES DUE TO YOUR UNAUTHORIZED DISCLOSURE OF ANY VULNERABILITY INFORMATION, AND YOU MAY ALSO BE HELD LIABLE BY THE REGULATORY AUTHORITY DUE TO VIOLATION OF APPLICABLE LAWS AND REGULATIONS. IN ADDITION, SANGFOR RESERVES THE RIGHT TO HOLD YOU LIABLE FOR BREACH OF CONTRACT AND DAMAGES IN ACCORDANCE WITH THE PROVISIONS ON CONFIDENTIALITY OF VULNERABILITY INFORMATION.
3. Remote Support
To help you confirm the security status of the Sangfor Product you use, reduce the cost incurred by you in checking and handling the risks that may arise from time to time, and improve the efficiency of risk handling, so as to better ensure the security of your network and business, a remote connection feature may be available to your Product based on your requirements and upon your consent. SANGFOR UNDERTAKES TO YOU THAT WE WILL NOT PERFORM ANY OPERATION THAT MAY CAUSE DAMAGE TO YOUR PRODUCT OR THE RELATED BUSINESS SYSTEM OR DATA THROUGH REMOTE ACCESS.
4. Centralized Product Management
You can perform centralized management of the Sangfor Products you use through the centralized management platform developed by Sangfor. When using the Product ID or code or other unique identification information to activate and connect your Product to the management platform, you should confirm the accuracy of the relevant information, and shall not activate or connect any third-party device to the management platform in any way without valid authorization. If you activate or connect any third-party device to the management platform due to misoperation, you shall immediately take remedies such as unbinding the device after discovering it or receiving a notice, or contact Sangfor for help.
5. After-sales Maintenance
5.1 Service System
Sangfor is committed to providing comprehensive, high-quality after-sales and technical support services to users. For more information about Sangfor's service policy and the after-sales service period or maintenance progress of your device, you can visit Sangfor's official website. In addition, you can obtain technical support through various online channels.
The after-sales maintenance service that Sangfor provides to you includes the free maintenance service included in the sold Sangfor Product and the paid maintenance service that Sangfor provides by renewing the contract or separately entering into a new contract with you. Sangfor can provide high-quality and efficient original after-sales services to you through our online service center, remote service center, and on-site service team. In addition, to better provide localized services to you and reduce your service cost, Sangfor may authorize our distributors and system integrators to provide after-sales services to you through channels. By providing standardized certification training and professional technical support to our distributors and other partners, Sangfor ensures that the after-sales services you receive meet the quality requirements, and can effectively solve various problems that may arise during your use of our Products or services.

5.2 Value-added Services
To further transform Sangfor's professional technical capability into user value, Sangfor may, in addition to providing deployment and implementation services for delivered Products and the basic after-sales technical support services in the sales process, offer various value-added services from time to time, including customized training services, on-site services, device and business health check services, as well as cloud-based professional services in terms of business migration, disaster recovery, remote monitoring and early warning, etc., so as to help users ensure the secure and stable operation of the business. In particular, during the important period of cybersecurity maintenance, Sangfor, as the cybersecurity product and service provider, is committed to fulfilling the cybersecurity protection obligation with users (network operators).
To provide a more complete and timely O&M guarantee service for the Sangfor security Product you use, Sangfor may also follow up and manage your requirements relating to the use of the Product through the distributor with whom you signed a contract when purchasing the Product. Prior to the expiration of the related software license or rule base of the security Product you use, our distributor may notify you by SMS to promptly update or upgrade it, so as to help you better implement the Product features and ensure the continuity and stability of your business.
6. Product Lifecycle
Sangfor manages Product lifecycle in strict compliance with the rules of the industry. Where necessary, Sangfor may withdraw certain Products from the market based on technological innovation, market demands, Product function iteration, or other reasons, according to the prescribed process. Therefore, please read the Sangfor Technologies Product Lifecycle Management Policy (for more information about the policy, see [https://www.sangfor.com.cn/iframeInset/index.html#/lifecycle]) carefully before purchasing or subscribing to Sangfor Products, so as to fully understand the lifecycle planning of related Products and reasonably arrange your procurement activities.
In addition, Sangfor will publish an announcement on our official website within a reasonable time before the occurrence of key milestones in the Product lifecycle (such as official withdrawal from the market), and where necessary, we will also contact you by email or phone, so as to guarantee your business stability as far as possible. You should also actively pay attention to and understand the service details of each key milestone in the full lifecycle of the Product you use, so as to help Sangfor provide strong support for your business development. YOU ACKNOWLEDGE AND AGREE THAT SANGFOR WILL ARRANGE PRODUCT SALES ACTIVITIES AND THE PROVISION OF TECHNICAL SUPPORT ACCORDING TO THE LIFECYCLE MANAGEMENT POLICY. SANGFOR HAS NO LEGAL OBLIGATION TO PROVIDE ANY TECHNICAL SUPPORT FOR END-OF-LIFE PRODUCTS.
Appendix 4: Risks Associated with the Product Features
1. Enabling of Audit function
If you configure and enable the workspace function in the policy management interface of Sangfor aTrust based on the demand of anti-disclosure and data security protection, a secure workspace will be set up for the authenticated End Users to access the internal network, and you can enable the audit function for the workspace to realize the security audit of the data copy, file import/export and screenshot behavior of the authenticated End Users. We kindly remind you that you shall manage the activation of the audit function independently to ensure that it is only enabled for the purposes of anti-disclosure and data security protection. Customer shall inspect the configuration of the function on a regular basis to ensure that the audit scope configured by the authorized management personnel is within reasonable and necessary scope to avoid the function from being used for any private purpose or improper purpose. Customer shall also manage the access permission of the audit log in order to avoid unauthorized access to the sensitive business information. If it is involved in viewing relevant files or data containing personal information of the end-user authentication through this function, the user shall guarantee that the express consent of the end-user authentication has been obtained in advance. Users shall bear all the consequences and related responsibilities resulting from enabling the function based on their own configuration. IF YOU VIEW THE RELEVANT FILES OR DATA CONTAINING THE PERSONAL INFORMATION OF THE AUTHENTICATED END USERS THROUGH THIS FUNCTION, YOU SHALL GUARANTEE THAT YOU HAVE OBTAINED THE EXPRESS CONSENT OF THE AUTHENTICATED END USERS IN ADVANCE AND SHALL UNDERTAKE ALL THE CONSEQUENCES AND RELATED RESPONSIBILITIES BASED ON YOUR OWN CONFIGURATION TO ACTIVATE THE FUNCTION.
2. Endpoint Application Associated Operation
During the use of Sangfor aTrust, you can centrally configure or publish resources through Sangfor aTrust for the authenticated End Users to use. Based on the different types of resources configured or published by you or the need of associating other internal systems for authentication and other access control demand, the authenticated End Users may need to pull up the corresponding program to run through Sangfor aTrust application installed on the terminal device to achieve resource access. You can configure the resources to be accessed through Sangfor aTrust authentication and the applications required to access the resources in the Sangfor aTrust management background based on your own needs, after the settings are completed, the applications required to be used by the authenticated End Users to access the corresponding resources will start running according to the configuration set by you, such as application type, display status, opening mode and authentication notice. YOU ACKNOWLEDGE AND AGREE THAT YOUR CONFIGURATION AND USE OF THE FUNCTION WILL ACT ON THE INSTALLATION AND OPERATION OF THE AUTHENTICATED END USERS'S DEVICE APPLICATION, AND YOU SHALL INFORM THE AUTHENTICATED END USERS AND OBTAIN THEIR CONSENT; AND YOUR DISTRIBUTION OF RESOURCES AND AUTHENTICATION OF ACCESS BEHAVIOR AND OTHER CONFIGURATION OPERATIONS WILL DIRECTLY AFFECT THE AUTHENTICATED END USERS' ACCESS TO THE RELEVANT RESOURCES, ACCESS EFFICIENCY, AND ACCESS SECURITY, YOU SHALL ENSURE THAT THE CONFIGURATION SCHEME USED MEETS ITS YOU BUSINESS NEEDS AND THE SECURITY REQUIREMENTS.
3. Endpoint Application Integration Deployment
In order to help Customer complete the installation and deployment of endpoint applications efficiently, Sangfor can provide the Customer with the "ALL IN ONE" solution for the endpoint application. CUSTOMER CAN DETERMINE THE RANGE OF ENDPOINTS TO BE CONTROLLED AND THE ENDPOINT APPLICATIONS TO BE INTEGRATED AND DEPLOYED ACCORDING TO YOUR MANAGEMENT NEEDS. CUSTOMER UNDERSTANDS AND AGREES THAT UNDER THE "ALL IN ONE" INTEGRATION DEPLOYMENT MODE, ONLY ONE APPLICATION INSTALLATION PROCESS IS REQUIRED ON THE ENDPOINT, AND ONLY ONE APPLICATION NAME MAY BE PRESENTED ON THE APPLICATION INTERFACE DURING INSTALLATION. THEREFORE, IN ADDITION TO THE ISSUES AGREED IN THIS AGREEMENT, CUSTOMER SHALL BE RESPONSIBLE FOR OBTAINING THE AUTHORIZATION AND CONSENT OF OR REACHING AN AGREEMENT WITH THE END USER OF THE ENDPOINT TO ENSURE THAT THE LEGAL RIGHTS AND INTERESTS OF THE RELEVANT INDIVIDUAL ARE NOT INFRINGED UPON WITH RESPECT TO THE INTEGRATED INSTALLATION AND OPERATION OF ALL FUNCTIONS OF THE ENDPOINT.
